General Terms and Conditions (GTC)
Applicable to orders placed via myterrain.art with MyTerrain.

1. Scope and contracting party
These General Terms and Conditions apply to all orders placed by consumers via the MyTerrain online shop at myterrain.art.
The contracting party is:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor part of their independent professional activity.
Deviating terms of the customer do not apply unless their validity has been expressly agreed.
2. Description of services
MyTerrain produces individual 3D relief maps according to specifications chosen by the customer, in particular based on a route or map area provided by the customer (e.g. GPX file or selected area), and according to the chosen design.
Products are generally manufactured individually for each customer only after receipt of the order.
Products, colours, materials and representations shown on the website are for illustration. Due to screen settings, material properties, manufacturing processes and individual design, minor deviations from the representations on the website may occur, insofar as these do not materially affect the agreed characteristics.
3. Order process and production time
The presentation of products in the online shop does not yet constitute a legally binding offer to conclude a purchase contract.
The customer can select a product, customise it and then place a binding order by clicking the designated order button.
The contract is concluded when MyTerrain accepts the order by sending an order confirmation by email. The automatic confirmation of receipt of the order does not yet constitute acceptance of the order, unless acceptance is expressly stated therein.
MyTerrain is entitled to reject an order within a reasonable period, in particular if data or files submitted by the customer are not suitable for producing the ordered product.
Regular production time is currently expected to be approximately 14 days plus the respective shipping time. The specific estimated delivery time is shown to the customer before completion of the order.
The stated production time is an estimate and may be exceeded in individual cases. This may occur in particular due to unforeseeable events or circumstances outside MyTerrain's control, for example significant supply bottlenecks for required materials, technical damage to production equipment, or temporary inability to manufacture.
MyTerrain will inform the customer of significant foreseeable delays where possible and endeavour to fulfil the order as promptly as possible.
If the order cannot be fulfilled within a reasonable period, the customer's statutory rights, in particular rights in case of delivery delay and statutory rights of withdrawal, remain unaffected.
A voluntary price reduction or other goodwill gesture may be offered in individual cases but does not establish a claim to such treatment in other cases.
4. Prices and payment
All prices stated in the online shop are in euros.
Due to application of the small business rule pursuant to Section 19 UStG, VAT is not shown separately.
A VAT identification number is currently being applied for and will be stated accordingly once issued.
Shipping costs may apply in addition to the product price. Applicable shipping costs are shown to the customer before completion of the order.
Payment is made via the payment service providers offered in the online shop, currently in particular via Stripe and the payment methods offered there.
The purchase price is generally due before production begins.
5. Gift vouchers
Gift vouchers may, if offered in the online shop, be redeemed for the products and under the conditions stated there.
Gift vouchers can generally be redeemed for three years from the end of the year in which they were purchased.
Cash payout of the voucher value is generally not possible.
Shipping costs may apply when redeeming a voucher. These are shown to the customer before completion of the respective order.
6. Right of withdrawal for personalised goods
Consumers generally have a statutory right of withdrawal. Details are set out in the separate withdrawal policy and the sample withdrawal form provided there.
For goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer, there is no right of withdrawal pursuant to Section 312g(2) No. 1 of the German Civil Code (BGB).
This may apply in particular to individually manufactured 3D relief maps produced based on a route, GPX dataset or other individual specifications provided by the customer.
Whether a specific order falls under this statutory exception depends on the individual design of the ordered product.
7. Warranty / liability for defects
Statutory rights regarding defects apply.
The customer is asked to report identifiable defects as promptly as possible after receipt of the goods, stating the order number and, where possible, providing meaningful photos or a description of the defect. The customer's statutory rights are not restricted by such notification.
In case of a defect, the customer has statutory rights, in particular to supplementary performance, withdrawal, price reduction and, where applicable, damages, in accordance with statutory provisions.
8. Liability
MyTerrain is liable without limitation for damage arising from injury to life, body or health and for damage based on intentional or grossly negligent conduct.
In case of slightly negligent breach of essential contractual obligations, MyTerrain is liable only for typical, foreseeable contract damage. Essential contractual obligations are those whose fulfilment enables proper performance of the contract in the first place and on whose compliance the customer may regularly rely.
Otherwise, liability for slightly negligent breach of duty is excluded.
The above limitations of liability do not apply where mandatory statutory liability exists, in particular under product liability law.
MyTerrain's liability for content and data provided by the customer, in particular GPX files, is limited to the extent permitted by law. The customer is responsible for ensuring that the content and data they provide may be used lawfully and do not infringe third-party rights.
